Terms & Conditions:

AGREEMENTS: You agree to hire MULBERRY CREATIVE CO. for the current project you are about to purchase.  As my customer/client, you have the ability to agree with these terms and conditions on behalf of your company or organization. You agree to provide me with everything that I may need to complete this project including text, images and other information as and when it is needed, and in the format that I may ask for in a timely manner. You agree to review my work, provide feedback and sign-off approval within 3 business days of me sending you an updated email. I will do my best to meet all the deadlines set but I can’t be responsible for a missed launch date or a deadline if you have been late in supplying materials. All projects must be finished within 30 days of checkout, unless otherwise discussed. This is to maintain my workload and schedule of new inquiries and projects. Upon receiving your order, and gathering all of your information and inspiration I typically take 5-7 BUSINESS DAYS to get you your first round of rough draft logo options; from there it will only take me 1-3 business days to make any changes. You will also receive 2 reworks of your final logo after the logo rough drafts. There will be a charge of $75 for every day the project goes past 30 days (60 days if you purchased the Signature Branding Package), unless otherwise discussed. You will agree to be present to any dates that we set together. You will be charged an hourly rate of $75 for misused time if you are to not be present at scheduled meetings. I have the ability to perform the services you will need and I will carry them out in a professional and timely manner. On top of this I will also maintain the confidentiality of any information that you give me.

 

DESIGN: Your project includes the one final design (plus any other final designs you checkout with) and the opportunity for you to make up to two rounds of revisions. If you’re not happy with the designs at this stage, you will be charged an hourly rate of $75 until we have settled on a final design.

 

a) Text content: I am not responsible for writing or inputting any text copy unless otherwise discussed. I will be happy to help though, and in addition to the cost I will charge you at $75 per hour for copy writing or content input.

 

b) Photographs: You will supply photographs either in digital or printed format. If you choose to buy stock photographs I can suggest vendors of stock photography. Any time spent searching for appropriate photographs will be charged at $30 per hour.

 

c) Websites: I design websites in Squarespace. If you would like another platform, please contact me before hand. You will be responsible for paying for your domain name, if not already purchased. And you will be responsible for paying for your monthly/yearly website hosting fee and any email address inboxes you would like to have along with your website. I will do all of the heavy lifting when it comes to that, you will just be in charge of the payment portion. I will walk you through the steps to checkout for both the domain and hosting.

 

TECHNICAL SUPPORT: I am not a web site hosting company so I do not offer or include technical support for web site hosting, email, domain or other services relating to web site hosting. If you do require help with anything beyond the design and setup of your site, I’ll be happy to help and you will be charged $75 per hour.

 

LEGALITIES: I can’t guarantee that the functions contained in any web page templates or in a completed web site will always be error-free and so I can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised me of the possibilities of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

 

COPYRIGHTS: You guarantee to me that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide for inclusion in the web site or design job are either owned by you or that you have permission to use. When the project is completed, copyright is automatically assigned as follows: You own the graphics/website and other visual elements that I created for you for this project. I will give you a copy of all files and you should store them safely as I am not required to keep them or provide any native source files that I used in the process of making them. You also own text content, photographs and other data you provided, unless someone else owns them. I reserve the right to display and link to your completed project as part of my portfolio and to write about the project on web sites, social media, in magazine articles and in books. I also retain the rights to any unused designs and have the ability to sell or do as I please with them.

 

PAYMENTS: I am sure you understand how important it is as a small business that you pay any invoices that I send you promptly. These terms and conditions stays in place and need not be renewed. If for some reason one part of these terms become invalid or unenforceable, the remaining parts of it remain in place. These terms and conditions are legal documentation under exclusive jurisdiction of the United States courts.
